Terms of Service

Last updated October 17, 2026

1. The service

Apollo lets you create AI voice agents that answer and place phone calls for your business, gives them phone numbers, and records the calls with transcripts and captured details. These terms are an agreement between you and Apollo ("we"). By creating an account you agree to them on behalf of yourself and the business you represent.

You must be at least 18 and use Apollo for a business, not for personal or household purposes.

2. Your account

Keep your login secure and tell us right away about any unauthorized use. You are responsible for activity in your workspace, including by team members you invite.

3. Plans, billing, and limits

Paid plans are billed monthly in advance through Stripe and renew until cancelled. Each plan includes a number of minutes, agents, and phone numbers; minutes beyond the allowance are billed at the plan's overage rate. We may pause outbound calling when a workspace reaches its plan's monthly ceiling. You can cancel any time from Team & billing; service continues to the end of the paid period. Fees are non-refundable except where required by law.

4. Calls, consent, and the law

You are responsible for how your agents are used. That includes: telling callers they are speaking with an AI and that calls may be recorded where the law requires it; having the consent required to call or text anyone (including prior express written consent for marketing calls under the TCPA); honoring do-not-call requests; and calling only during permitted hours. Our tools help (disclosures, calling windows, opt-out lists), but they don't replace your own compliance.

You may only connect phone numbers you own or are authorized to use. We verify ownership of numbers you bring.

If you turn on text messages (such as booking confirmations), send only messages your callers asked for, honor STOP replies, and follow carrier rules.

You will defend and indemnify Apollo against claims, fines, and costs arising from your agents' calls and messages, including claims under the TCPA, telemarketing, call-recording, and do-not-call laws, and from your content, your contact lists, or your breach of these terms.

5. Acceptable use

Don't use Apollo to harass, deceive, or defraud anyone; to impersonate a person or organization; to place robocalls or spam; to collect payment card numbers, Social Security numbers, or passwords by phone; to provide medical, legal, or emergency services in place of a professional; or to break any law. We may suspend agents or accounts that do.

6. AI output

Agents generate responses with AI and can make mistakes. Review your agent's behavior with the testing tools before going live, and don't rely on it for decisions where an error could cause harm.

7. Your data

You own your content: agent settings, call recordings, transcripts, and records. You give us permission to host and process it to run the service. For data about your callers and contacts, you are the controller and we process it on your behalf; you are responsible for any notices and consents your callers need. Our Privacy Policy explains how.

8. Third-party services

We run the service using trusted infrastructure, voice and telecommunications providers under our own accounts, so you don't need to set up or manage them. Their availability can affect ours.

9. Disclaimers and liability

The service is provided "as is." To the extent the law allows, we aren't liable for indirect or consequential damages, and our total liability is limited to what you paid us in the 3 months before the claim.

10. Suspension and termination

We may suspend an agent, a number, or an account right away if we reasonably believe it is being used unlawfully or abusively, or if a carrier or provider requires it. You may close your account at any time. When an account closes, we cancel billing and delete your data as described in the Privacy Policy, except billing records we must keep by law.

11. Governing law

These terms are governed by the laws of the state where Apollo is organized, without regard to conflict-of-law rules. If any part of these terms can't be enforced, the rest still applies. These terms are the whole agreement between us about the service.

12. Changes and contact

We may update these terms and will tell you about material changes. Questions: jorgeochoareyes@gmail.com.
